The creation of the so-called “Sahrawi instance against Morocco occupation” is an illegitimate provocation

Ammon News - It is reported that the individual named Aminatou Haidar has engaged in a new provocation through the creation in a private residence in Laayoun, on September 2020, in violation of current health regulations, of the self-styled Sahrawi commission against Moroccan occupation" (isacom") de facto group, regarding which no autorotation has been filed.

It is considered that this action is illegal under Moroccan law that takes place as the Security Council is about to consider the issue of the Moroccan Sahara. It echoes the usual repertoire of Algeria and polisario's provocations on the eve of each UN milestone.

It is no coincidence that this propaganda action intervenes at the same time as provocations continue east and south of the Moroccan defence apparatus, particularly in the Guerguerate buffer zone.

During the initial “congress” of this group, which has been held under the name of former separatist chief Mohammed Abdelaziz, the participants have announced their "readiness to militate for the liberty and the independence of the sahrawi people" The site of the event, which brought together thirty people, was ornamented with flags of fictitious "sadr".

The provocation of Haidar is an evident violation of the Constitution of the Kingdom of Morocco, which provides that civil society associations and non-governmental organizations shall be constituted and exercise their actives in complete freedom, providing that these comply with the Constitution and the law Thus, there exist more than 209.000 associations in Morocco, among which 4.000 authorized associations in the regions of Laayoune-Sakia El Hamra and Dakhla Oued Eiddahab.
The relevant provisions of the law are clear and unambiguous. Article 7 of the 1958 Dahir on the law of associations provides that "any association or de facto groups that are intended to harm the integrity of the national territory shall be dissolved". In the same vein, article 233 of the Penal Code provides that when illegal measures are devised in the context of a meeting of individuals… culprits shall be sentenced to a prison term ranging from one to six months”.
In full respect of the constitutional and legal provisions and the rules of the Kingdom of Morocco, the Prosecution Service has launched a criminal investigation into the "congress" of "isacom".

This self-proclaimed “ human rights defender “ has never referred to the human rights situation in the Tindouf camps, even as in her capacity of the so called "codesa" association, which has been dissolved by its own members since then. Haidar has never referred publicly t1o the arbitrary detentions, enforced disappearances, extrajudicial executions, rapes, and sequestration of which the Tindouf camps population are victim.
Aminantou Haidar, who travels on a Moroccan passport, is not subject to any restriction on her freedom of movement, as is the case of all other Moroccan nationals. A former civil servant, she has been compensated by the equity and Reconciliation Commission for the past human rights violations, she has suffered. Evidently, Haidar viciously manipulates the atmosphere of freedom that prevails in the Moroccan Sahara to improve her public status and serve her personal agenda. A self-portrayed "pacifist militant", Haidar has utilized the freedoms guaranteed by law to take military training abroad, and encourage youngsters from the region to follow course.
Handar's larest provocation illustrates that Morocco has always been explaining to its partners. Haidar's will to serve Algeria’s and polisario's agenda in the Moroccan Sahara.

The fallacious and politicized appellation of "isacom":
The fallacious, provocative, and heavily politicized denomination of this de facto group materializes the shift of Haidar's activism from the field of human rights to that of purely political aspects of the Moroccan Sahara issue.
Indeed, the concept of "occupation" is frequently manipulated by Algeria and "polisario" in the context of their propaganda actions, although it does not correspond to the situation of the Moroccan Sahara, whether de jure or de facto.
Indeed, the Hague Rules of 1907 and the IV the Geneva Convention of August 12, 1949 as the military presence of one State on the national territory of another sovereign State define the concept of occupation. At the time of its recovery in 1975, no sovereign State other than Morocco was present in the Moroccan Sahara.
None of the Secretary General's reports and none of the Security Council's resolutions refer to any so- called "occupation" of the Moroccan Sahara.
The public statements Haidar made through Algeria's official press agency, Algérie Presse Service, following the peaceful operation conducted by the Royal Armed Forces to reinstate free civilian and commercial traffic at the Guerguerate border crossing demonstrate, yet again, her role as an agent of the ambitioas of Algeria and "polisario" in the Moroccan Sahara.

The illegitimate nature of Haidar's claim to speak on behalf of the population of the Moroccan Sahara:
Haidar, who claims to speak on behalf of the "Sahrawí people", does not represent anyone else than herself. The only legitimate representatives of the population of the Moroccan Sahara are the elected local representatives of the Southern Provinces, who can avail themselves of the legitimacy of democratic elections.
During the first regional elections of the history of Morocco, which were held in 2015, the turmout rate was more than 70%, in polls deemed as “free of incidents" by the UN Secretary General in his report S/2016/355.
Two persons that originate from the region have been elected as Presidents of the two Regional Councila of the Sahara, among whom one is a former "polisario" official who rallied the Motherland in 1998.

The representativeness of the elected representatives of the Sahara has been recognized by the Commit of Twenty-Four, which has invited these representatives to take part in its Regional Seminar, held Granada on May 2-4, 2019, and its main session, held in New York from the 17h through the 28 of! 2019.
The representativeness of the elected local representatives of the Moroccan Sahara has also recognized by the European Union in the framework of the renewal of the Morocco-EU Agrie Agreement, on January 17, 2019, and the Morocco-EU Fisheries Agreement, on February 2019 course of the renewal local officials of the Sahara to establish that the local population consents to, and benefits extraction of natural resources in the region.

Morocco asks of friend countries not to accept any request to meet with Haidar, and recognition to the activities of a so-called "association" whose main objective is to destabilize the calm situation that prevails in the Moroccan Sahara, in violation of Moroccan law.
